What is Account Protection®?
Account Protection is an overdraft privilege requiring no action on your part. You do not have to sign anything. Your overdraft privilege (Account Protection® limit) amount will be automatically assigned.
How does Account Protection® work?
As long as you maintain your account in good standing (defined as making regular deposits and bringing your account to a positive balance at least once every 30 days) MidSouth Bank may honor overdrafts up to the Account Protection® limit on your account. If you use Account Protection®, you should remember the bank's normal overdraft fee for each transaction will be deducted from your limit. The overdraft fee is deducted from your account each time an insufficient check or debit item is presented for payment from your account. As in the past, the bank will notify you by mail when an overdraft occurs. No interest will be charged on the over-draft balance. You will receive an overdraft notice in the mail each time items are paid. The notice will show the check number, amount and the overdraft fee. You should subtract total fees from your checkbook.
I have two checking accounts. Can I get Account Protection® on both?
Yes. If you have multiple accounts for your household, you may have a limit on all eligible accounts.
What if I go beyond my Account Protection® limit?
Overdrafts above and beyond your established Account Protection® limit may result in a check or checks being returned to the payee. The normal overdraft fee will be charged per check and assessed to your account. An overdraft notice will be sent to notify you of our actions.
What are some of the ways I may have access to Account Protection®?
Generally, you may access your Account Protection® through:
- Checks and other debits cashed at teller windows
- ATM/Check Card
- ACH debit transactions
- Checks issued to a third party
- All transactions that currently are honored through your account
How quickly must I repay my Account Protection®?
You should make every attempt to bring your account to a positive balance within 30 days. If you are not able to do so, you will receive a letter from MidSouth Bank informing you of the situation and your options. If, after a period of time, your account has not been brought into a positive balance, we will have no option but to close your account and take other steps to recover funds. There is no additional cost associated with this privilege if you bring your account to a positive balance once every 30 days. As stated previously, you should keep in mind that you will be charged an overdraft fee for each check paid under the limit.
How soon can I use my Account Protection®?
If you are a new account holder, you will be able to use the overdraft privilege 30 days after the account is opened.
How can I find out what my Account Protection® limit is?
To find out your Account Protection® limit and fee charges that may apply for accounts that don't have Account Protection, simply call our Customer Care Center (800) 213-BANK (2265) or come by any of our office locations.
When I call MidSouth Bank's Touch Tone Banking Service to get my balance, is my Account Protection® limit included?
No, the balance reflected through our Touch Tone Banking Service will not include the overdraft limit assigned to your account.
Customer Overdraft Policy
A SPECIAL OVERDRAFT PRIVILEGE FOR CHECKING
An insufficient balance could result in several ways, such as (1) the payment of checks, electronic funds transfers, or other withdrawal requests; (2) payments authorized by you; (3) the return of unpaid items deposited by you; (4) the imposition of bank service charges; or (5) the deposit of items which, according to the bank's Funds Availability Policy, are treated as not yet available. We are not obligated to pay any item presented for payment if your account does not contain sufficient funds. However, if you maintain your account in good standing (defined as making regular deposits and bringing your account to a positive balance at least once every 30 days) and there are no legal orders outstanding, we may approve your reasonable overdrafts as a non-contractual courtesy. Normally, we will not approve an overdraft for you in excess of the pre-determined amount assigned to your account type, plus our overdraft fee(s). We may refuse to pay an overdraft for you at any time, even though we may have previously paid overdrafts for you. You will be notified by mail of any non-sufficient funds items paid or returned that you may have; however, we have no obligation to notify you before we pay or return any item. The amount of any over-draft plus our overdraft fee(s) that you owe us shall be due and payable upon demand. If there is an overdraft paid by us on an account with more than one (1) owner on the signature card, each owner and agent, if applicable, drawing/presenting the item creating the overdraft, shall be jointly and severally liable for such overdraft plus our overdraft fee(s) of $32.00. You should note that your Account Protection® limit may be included in your available balance provided by a teller, on an ATM inquiry, and through Net Banking, our Internet Banking Service.
LIMITATIONS: Available to individually/jointly owned accounts in good standing for personal or household use. MidSouth Bank reserves the right to limit participation to one account per household and to discontinue this product without prior notice.
